These Terms and Conditions (“Agreement”) govern your use of the air conditioning, refrigeration, and electrical services provided by Mondo Air & Electrical. By availing of our services, you agree to abide by these terms and conditions. Please read this Agreement carefully before using our services.

1. Service Agreement:

1.1. The Company agrees to provide air conditioning, refrigeration, and electrical services as described in the agreed-upon service request or work order.

1.2. The client agrees to provide accurate and complete information regarding the service requirements and any relevant site-specific details.

2. Service Provision:

2.1. The Company will make reasonable efforts to provide services in a timely and efficient manner. However, the actual completion time may vary depending on the complexity of the task, availability of parts, and other unforeseen circumstances.

2.2. The Company reserves the right to refuse service or cancel a service request if it is deemed unsafe, illegal, or unethical.

2.3. The client agrees to provide necessary access to the premises and equipment required for the service. Any delays caused due to restricted access or unavailable equipment shall not be the responsibility of the Company.

3. Payment and Invoicing:

3.1. The client agrees to pay the agreed-upon fees for the services rendered by the Company. Payment terms and methods will be discussed and agreed upon before the commencement of services.

3.2. Invoices are payable within the agreed-upon time frame, usually upon completion of the service. Failure to make timely payments may result in additional charges or suspension of services.

3.3. The client is responsible for any additional costs incurred during the provision of services, such as the purchase of replacement parts, materials, or equipment, unless explicitly stated otherwise in the service agreement.

4. Warranty and Liability:

4.1. The Company warrants its services to be performed with reasonable care and skill in accordance with industry standards.

4.2. Any parts or equipment supplied by the Company may be subject to separate warranty terms and conditions provided by the manufacturer or supplier.

4.3. The Company shall not be liable for any damages, losses, or injuries arising from the use of its services, except in cases of willful misconduct or gross negligence.

4.4. The client agrees to indemnify and hold the Company harmless from any claims, demands, or liabilities arising out of or related to the services provided, except in cases of the Company’s negligence or breach of this Agreement.

5. Intellectual Property:

5.1. All intellectual property rights, including but not limited to copyrights and trademarks, related to the Company’s services, logos, and materials remain the exclusive property of the Company.

5.2. The client shall not reproduce, modify, or distribute any copyrighted material or proprietary information of the Company without prior written consent.

6. Confidentiality:

6.1. Both parties agree to keep any confidential information obtained during the provision of services confidential. This includes but is not limited to trade secrets, business processes, customer data, and financial information.

6.2. The client agrees to allow the Company to use their name and logo for promotional purposes, unless explicitly stated otherwise in writing.

7. Termination:

7.1. Either party may terminate the service agreement by providing written notice to the other party.

7.2. Termination shall not relieve the client of any outstanding payment obligations for services already rendered.

7.3. The Company reserves the right to terminate services immediately if the client breaches any provisions of this Agreement or engages in illegal or unethical activities.

8. Governing Law and Dispute Resolution:

8.1. This Agreement shall be governed by and construed in accordance with the laws.

8.2. Any disputes arising out of or in connection with this Agreement shall be resolved through amicable negotiation between the parties. If a resolution cannot be reached, the dispute shall be submitted to binding arbitration in accordance with the rules.

9. Entire Agreement:

9.1. This Agreement constitutes the entire understanding between the client and the Company regarding the provision of air conditioning, refrigeration, and electrical services and supersedes any prior agreements, understandings, or representations.

By using our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
